Standard Hosting Terms and Conditions for Websites supplied by WebEnable
1. WebEnable is a not-for-profit organisation whose purpose is to provide accessible websites for people with a learning disability. WebEnable provides high quality websites at
low cost on a shared system and all websites provided by WebEnable are subject to these Terms and Conditions.
2. WebEnable’s target uptime for the provision of websites hosted by WebEnable is 99.4 % but WebEnable gives no warranty as to the complete availability of any website
hosted by WebEnable. In particular, WebEnable takes no responsibility for routine maintenance operations which can cause a service interruption or have a temporary impact on
performance or for failures caused by
circumstances
beyond our reasonable control, including, without limitation, acts of any governmental body, war, terrorism, insurrection, sabotage, embargo, fire, flood, strike or other labour disturbance, unavailability of
interruption or delay in telecommunications or third party services
(including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of the Website.
3. Back-up copies of the Website are taken every 24 hours and are securely stored off-site.
4. WebEnable provides a Client support service which can be accessed during normal office hours by e-mailing
. We will make all reasonable efforts to respond to requests for support within 24 hours, Monday to Friday.
5. WebEnable has no responsibility for any content on any website provided by WebEnable and does not warrant that the information provided is complete or sufficient or fit
for any purpose and further gives no warranties, express or implied, as to the accuracy or completeness of the information contained in or derived from or through any website provided by WebEnable.
6. WebEnable disclaims and excludes to the fullest extent permitted by law all liability for any loss or damage of any kind whatsoever including but not limited to any
indirect, special, consequential or secondary loss or damage or any loss of profit, time, contracts or goodwill or anticipated savings incurred by you howsoever arising in connection with the use of any website
provided by WebEnable.
7. A link to a service or site outside a site provided by WebEnable is not an endorsement by WebEnable of the service or site, its content or sponsoring organisation.
8. There are inherent risks in the use of any software and information found on the internet or world wide web and you acknowledge that you understand these risks before using WebEnable’s services. The use of a
website provided by WebEnable is at your own risk and WebEnable will not be liable for any damages or injuries arising out of computer virus or other destructive or disruptive material or any failure of hardware or
software or theft or damage to your own material or systems consequent on your use of any website provided by WebEnable whether caused by our negligence or not.
9. WebEnable
reserves the right to increase hosting fees at the end of any year when there are increased costs for the shared services but will endeavour to
keep any such increases to a minimum and will give you three months prior notice of such increases. You understand that because you are sharing applications, your site
cannot be hosted other than through us.
